You can't just build your own modpack, or well, you can, but if you do, some of the mods license files will be violated.
e.g xycraft is only permitted to ship with the official FTB modpacks.

ONLY Feed The Beast has my permission to redistribute XyCraft at this time. For now that is the one and only mod pack that has that permission until future notice. (Feed The Beast as in FTB) Asking me currently changes nothing, the Answer is no until I get better situated. [This is not permanent]

I'm sure some of the other mods also have similar licenses.

Not to mention, even if this weren't potentially a violation of one or more intellectual properties to make your own mod pack and then ship it out to one or more people without consulting the modders, it's also a nightmare and a half to assemble. Lots of mods will have conflicts with their IDs, and both 1) having those conflicts resolved and 2) leaving space for future mod updates which would add new items takes a long time, not to mention adjusting the configuration files to your liking.

This is why FTB takes so long to update even once all of the mods are updated, as the team has to take into account any and all new blocks and items, any and all new features along with previous blocks/items/features, make sure that there are no item ID conflicts, make sure there is enough space for future IDs, make sure that the configuration files are compatible and the mods work together and make sure that the config settings set the right difficulty. Only then is the pack ready for release.

I think that you can make a private server pack without permission from the modders

If you're gathering mods to be distributed together (aka, making a modpack), you need the permissions to distribute each and every mod in the pack from the corresponding modder. If you're gathering mods together and putting them on a server, and telling all users of the server to get those mods individually and separately just as you did, you shouldn't need permissions because each user will be agreeing to the terms of each mod when they download it.

Why do you even need a modpack? Biomes O' Plenty is already on, extra biomes is not, and you can add ars magica easily.
